1. ACCEPTANCE OF TERMS
These Terms and Conditions of Sale govern auctions conducted by Eagles Corps International, LLC (“Eagles Corps,” “Auctioneer,” “we,” or “us”). By registering or placing a bid, you acknowledge that you have read and agree to these terms and any auction-specific conditions disclosed before you bid. When bidding through a third-party platform, you also agree to that platform’s applicable terms and payment procedures. Please review the lot description, photographs, available condition information, buyer’s premium, transaction fees, and shipping requirements before bidding. Nothing in these terms excludes rights or remedies that cannot lawfully be excluded.
2. BIDDING AND FORMATION OF CONTRACT A bid is an offer to purchase. A binding purchase contract is formed when the Auctioneer accepts the winning bid and closes the lot, subject to any disclosed reserve or auction-specific condition. The accepted winning bid is the “hammer price.” Bidders must be legally competent to contract and provide accurate registration, contact, payment, and shipping information. You are responsible for bids submitted through your account or by your authorized representative. The Auctioneer may set bidding increments, reject bids, resolve competing or simultaneous bids, and determine the winning bidder, subject to applicable law and platform rules. Lots may be withdrawn or corrected before acceptance of a winning bid. Corrections or changes affecting a lot must be communicated to affected bidders before the lot closes. Material changes to fees or other purchase obligations will not be applied retroactively to an accepted purchase.
3. BUYER’S PREMIUM A buyer’s premium is added to the hammer price of each lot at the following rates:
• Eagles Corps website: twenty percent (20%).
• BidSpirit: twenty percent (20%).
• LiveAuctioneers: twenty-four percent (24%).
• HiBid: twenty-four percent (24%).
• Accepted direct absentee, telephone, or in-person bids: twenty percent (22%).
The buyer’s premium is calculated on the hammer price. The applicable rate is determined by the platform or bidding method through which the successful bid is accepted, regardless of payment method. Any different rate for a particular auction or additional bidding venue must be disclosed before bidding.
4. TRANSACTION FEES AND CREDIT-CARD PAYMENTS LiveAuctioneers purchases: An additional three percent (3%) transaction fee applies to all purchases made through LiveAuctioneers, regardless of payment method. Other platforms and venues: An additional three percent (3%) credit-card transaction fee applies only to payments made by credit card, subject to applicable law and payment-network requirements. No credit-card transaction fee applies to payments made by cash, check, wire transfer, or another accepted non-credit-card method. Debit and prepaid cards are not subject to the credit-card surcharge. Each applicable percentage fee is calculated on the invoice amount being paid, including the hammer price, buyer’s premium, applicable taxes, and shipping or handling charges shown on that invoice, before the transaction fee itself is added. Where shipping is invoiced separately, an applicable fee is calculated on that separate invoice; the same charge is not assessed twice on the same invoice amount. For credit-card-only surcharges, the fee will not exceed the business’s applicable credit-card processing cost or any lower limit required by law or the payment network. If a lower amount is required, that lower amount will apply. Where required, the applicable credit-card price, inclusive of the surcharge, will be clearly and conspicuously displayed before the purchase is completed. A percentage disclosure in these terms does not replace required price disclosures. Taxes will be calculated and collected as required by applicable law.
5. INVOICING AND PAYMENT Payment is due upon receipt of the purchase invoice and must be completed within three (3) calendar days after the invoice is issued, unless a different deadline was disclosed before bidding or Eagles Corps agrees otherwise in writing. For LiveAuctioneers purchases, payments are processed through Live.Payments under the platform’s applicable authorization and payment procedures. The payment method on file may be automatically charged in accordance with those procedures. Bidders must arrange any permitted alternative payment method before an automatic charge is processed; submitting a request does not itself suspend automatic charging. For purchases through other platforms or directly through Eagles Corps, follow the secure payment instructions supplied with your invoice. Accepted payment options include credit cards and wire transfers. Other methods require prior approval. Do not send full credit-card numbers or card security codes by email. Verify unexpected payment instructions or requests to change wire-transfer details by calling Eagles Corps at 315-503-1540. Invoices are denominated in U.S. dollars unless expressly stated otherwise. Items will not be released until required payments have cleared. The buyer is responsible for charges imposed by the buyer’s bank in sending payment. A declined payment does not cancel the purchase or extend the payment deadline. Any charge for a declined payment must be separately disclosed before bidding and permitted by applicable law and payment rules; no automatic minimum declined-payment fee is imposed under these terms.
6. NONPAYMENT AND DEFAULT Failure to pay within the applicable payment period constitutes default. Eagles Corps may contact the bidder, report nonpayment through the applicable platform’s dispute process, restrict future bidding, and exercise available contractual and legal remedies. If payment remains outstanding ten (10) calendar days after the purchase invoice is issued, Eagles Corps may, after providing any legally required notice, cancel the unpaid sale and resell the lot to a backup bidder, another purchaser, or at a later auction. Any resale will be conducted in good faith and in a commercially reasonable manner. To the extent permitted by law, the defaulting buyer may be responsible for a recoverable resale shortfall and reasonable incidental expenses, including reasonable resale and collection expenses and reasonable attorneys’ fees incurred in enforcing the purchase contract. Any claim will account for applicable payments, resale proceeds, and expenses saved, and will not duplicate recovery of the same loss. Cancellation or resale does not itself waive a lawful claim arising from the buyer’s default. Eagles Corps will not collect the full original purchase price and retain resale proceeds as duplicate compensation for the same obligation.
7. DESCRIPTIONS, CONDITION, AND AUTHENTICITY Items are sold AS IS and WHERE IS, subject to the express representations made in the lot description, the claim procedure below, and applicable law. To the fullest extent permitted by law, Eagles Corps disclaims implied warranties of MERCHANTABILITY and FITNESS FOR A PARTICULAR PURPOSE. Historical and collectible items may show wear, deterioration, repairs, alterations, replacement components, or other effects of age. Photographs form part of the lot information, but may not show every defect, and displayed colors may vary. The absence of a condition statement does not mean an item is free of defects. Statements identified as opinions, estimates, reported provenance, or qualified attributions should be understood as such. Terms such as “attributed to,” “believed to be,” and “reportedly” indicate uncertainty and do not represent an unqualified identification or independently verified provenance. Eagles Corps does not provide an independent third-party authentication certificate or a separate lifetime authenticity guarantee unless expressly stated for a particular lot. However, these terms do not negate an express factual representation in a lot description or exclude liability or remedies that cannot lawfully be excluded. Bidders should inspect items, request additional photographs or condition information, and consult qualified specialists before bidding when age, authorship, provenance, originality, or authenticity is material to their decision. Pre-auction inspection is available by appointment where practicable.
8. CLAIMS AND RETURNS All sales are final, except for a substantiated material misdescription or another remedy required by applicable law. Returns are not accepted solely because of a change of mind, buyer’s remorse, a difference in perceived value, or a condition disclosed in the lot information. A material misdescription is a substantial factual error in the lot description that materially affects the item’s identity, character, or value. An authenticity concern will be considered when it bears on an express factual representation in the lot description. A third-party opinion does not automatically establish a misdescription, but supporting evidence will be reviewed. To request a return, notify Eagles Corps in writing at info@eaglescorps.com within seven (7) calendar days after delivery or pickup. Identify the lot number, explain the alleged error, and provide photographs and any reasonably available supporting documentation. Additional documentation may be supplied within a reasonable period agreed with Eagles Corps. This contractual notice period does not shorten any nonwaivable statutory right or remedy. Do not return an item without written authorization. Preserve it in the condition received; do not clean, repair, alter, dismantle, or otherwise modify it while a claim is pending. Reasonable examination needed to document a claim is permitted. For an approved material-misdescription return, Eagles Corps will provide return instructions and a reasonable return deadline. Upon receipt and verification of the returned item, Eagles Corps will refund the hammer price, buyer’s premium, transaction fee, and taxes attributable to the returned item, together with reasonable original and return shipping costs attributable to that item. Other remedies apply where required by law. Late payment does not, by itself, remove rights concerning a material misdescription or rights that cannot lawfully be waived.
9. SALES TAX AND EXEMPTIONS Applicable sales or use taxes will be collected by Eagles Corps or the relevant marketplace as required by law. Rates and taxable amounts depend on the transaction, delivery or pickup location, and applicable jurisdiction. Buyer’s premiums, shipping, handling, and other charges will be included in the taxable receipt where required. A single statewide New York tax rate does not apply to every transaction. A purchaser claiming a resale or other exemption must provide a properly completed, valid exemption certificate and any necessary supporting information before payment is processed. A resale number alone may not be sufficient. Refund requests involving tax already collected are subject to applicable law and the collecting platform’s procedures. International purchasers are responsible for applicable import duties, customs charges, and destination-country taxes, except where collection by Eagles Corps or a platform is legally required.
10. SHIPPING, HANDLING, AND INTERNATIONAL DELIVERY Shipping, packing, handling, and any agreed insurance costs are the buyer’s responsibility unless the lot description expressly states otherwise. Availability depends on the item, destination, carrier, and applicable restrictions. When shipping is invoiced separately, Eagles Corps generally issues the shipping invoice within three (3) business days after cleared payment of the purchase invoice and confirmation of shipping arrangements. Oversized, fragile, restricted, or freight items may require additional time or an outside shipper. Shipping invoices are due upon receipt. Items generally ship within seven (7) to fourteen (14) business days after cleared payment of both the purchase invoice and all applicable shipping charges. This is a shipment-processing period, not a guaranteed delivery date. If a material delay arises, Eagles Corps will communicate the revised arrangements. Buyers must provide a complete, accurate delivery address. Additional costs caused by an incorrect address, failed delivery, or buyer-requested rerouting are the buyer’s responsibility where permitted by law. International and restricted-item shipments are subject to export, import, customs, carrier, and other applicable requirements. Eagles Corps may decline a destination or shipping method that cannot lawfully or practically be accommodated. Customs declarations will accurately describe the goods and transaction value. Report shipping damage promptly to Eagles Corps, retain the packaging, and provide photographs so a carrier or insurance claim can be pursued. Carrier procedures do not replace any applicable rights against the seller.
11. RUSH AND SPECIAL SHIPPING Rush processing may be requested and is subject to advance confirmation of availability. If accepted, a twenty-dollar ($20) rush-processing fee applies in addition to ordinary shipping and handling charges. Special packing, expedited transportation, and other requested services are charged separately at the disclosed amount. Rush processing does not guarantee a carrier delivery date. If accepted rush processing cannot be provided, the rush-processing fee will be refunded.
12. PICKUP, STORAGE, AND UNCOLLECTED PROPERTY Pickup at our Syracuse, New York location is available by appointment. Buyers must collect their items or complete agreed shipping arrangements within twenty-one (21) business days after cleared purchase payment, unless Eagles Corps agrees otherwise in writing. This deadline does not apply to a delay caused by Eagles Corps after the buyer has timely provided shipping information and paid the required shipping charges. For items remaining uncollected because the buyer has not arranged pickup or shipping, Eagles Corps will provide written notice describing the outstanding requirements and allowing at least fourteen (14) calendar days to respond and arrange removal. Storage charges will apply only if the amount or rate and the start date have been disclosed in writing before the charges accrue, and only to the extent permitted by law. An item is not automatically deemed abandoned, and its purchase payment is not automatically forfeited, solely because the twenty-one-business-day period has expired. Any lien enforcement, resale, or disposition will follow applicable law, including required notices and accounting for proceeds.
13. AUCTION TECHNOLOGY, CORRECTIONS, AND INQUIRIES Online bidding may be affected by connection failures, transmission delays, software errors, or platform outages. Eagles Corps does not guarantee uninterrupted access or receipt of every attempted bid. To the extent permitted by law, Eagles Corps is not responsible for bids that were not received or accepted because of technical difficulties beyond its reasonable control. The Auctioneer may pause, postpone, or resume bidding as reasonably necessary, subject to applicable law and platform rules. An accepted sale will not be changed solely by invoking a general announcement-precedence provision. Submit pre-auction questions, inspection requests, and condition-report requests at least twenty-four (24) hours before the scheduled auction start. Times are stated in Eastern Time unless otherwise indicated. Eagles Corps will make reasonable efforts to respond but cannot guarantee a response to every request. This inquiry deadline does not govern post-sale claims.
14. HISTORICAL MATERIALS Eagles Corps sells historical collectibles and memorabilia for collecting, study, and preservation. Offering an item associated with a historical regime, organization, or conflict does not constitute endorsement of that regime’s beliefs or conduct. Eagles Corps does not endorse Nazism, hatred, violence, or racial intolerance. 15. GOVERNING LAW AND GENERAL PROVISIONS These terms and transactions with Eagles Corps are governed by New York law, subject to mandatory laws that apply to a particular transaction or purchaser. If a provision is found unenforceable, the remaining provisions will continue to apply to the extent permitted by law. No provision restricts nonwaivable consumer rights or remedies.
